Capitol Food Mart Decision

Subject: Mixed decision on the Capitol Food Mart protest

One and all,

I hope everyone is doing well. The ABC board finally released its decision today on Capitol Food Mart. The board approved the Class B beer and wine alcohol license, but the store is banned from selling single containers of beer or malt liquor. The owner also has promised to not devote more than 15 percent of the store space to alcohol sales.

I wish we could have blocked the license, but we received some concessions. I have attached the decision if anyone wants to read it. The board decided that the ban on single sales would limit public safety problems relating to public intoxication, loitering, etc. I couldn’t believe that the board didn’t find an overconcentration of alcohol outlets, but the order just mentions other Class B stores, not the huge number of liquor stores already in the neighborhood.

There is an active protest now against Full Yum’s application for a Class A liquor license. I’m not directly involved but Geovani Bonilla (gbonilla@hospicemanagement.com) can provide more info if anyone wants to help. Thanks to everyone for your time and effort in this protest! I think we can call it a success even if it wasn’t an outright victory.

Cheers,
Brendan L. Smith
