Madame Chairperson,
As President of the Bates Area Civic Association, Inc., I respectfully request to present at the October ANC 5E Meeting a request for support of a resolution voted on unanimously by the Bates Area Civic Association, Inc during our monthly meeting held on Monday, September 16, 2013.
The resolution was presented to Commissioner Joyce Robinson-Paul for support. Commissioner Robinson-Paul has chosen not to represent the concerns raised by the residents of her single member district pertaining to this matter and not to support the Bates Area Civic Association in correcting the illegal actions that took place.
Statements of Fact:
- On August 16 and 17 of 2013, The Community Academy of Public Charter Schools (CAPCS) located at 1400 First St NW, build an illegal parking lot for 144 cars.
- Upon inspection by the District Department of the Environment, CAPCS was issued financial fines of $4,000 per day for constructing the parking lot without:
- Construction permits
- Environmental studies
- Proper water drainage
- Permits from the Office of Zoning and DCRA were filed after construction had been completed.
- The project was built without community notification, illegally and without coming to the ANC for input and great weight.
- The parking lot was built covering thousands of square feet of land in a designed high risk flood zone (per FEMA and DDOE designation).
The Residents of the Bates Area Civic Association are seeking support from the ANC to ensure the illegal construction site is removed and that the proper process is followed for consideration to rebuild.
