Thanks for the notice. I attended an earlier hearing in DC Superior Court and was invited by Attorney Barnes to say a few words at the protest rally in front of the courthouse. Now a very similar environmental crime, without impact studies or community/ANC engagement, has been inflicted on my Bates/Truxton Circle neighborhood by a politically connected local businessman with the acquiescence of some government officials. I will try to attend next Tuesday’s Court of Appeals hearing, time permitting.

FRIENDS: The Ivy City ruling is important to everyone who cares about upholding the laws for Advisory Neighborhood Commission (ANC) notice and input, Environmental Impact studies as well as the principle of communities such as Ivy City not being treated as a dumping ground! In July 2012 Ivy City residents filed suit against DC Mayor Vincent Gray and the Union Station Redevelopment Corporation to Block the Construction of a Diesel-Bus Parking lot and “Driver’s Lounge” on the site of the cherished historic Alexander Crummell School, in the heart of the community. Tiny Ivy City, long treated as a dumping ground by the District and littered with over 10 acres of parking lots for diesel trucks and buses, is fighting for its residents’ right to breathe and to live. In December, Judge Macaluso GRANTED the injunction, preventing the city from operating the diesel bus parking lot. Mayor Gray has appealed her ruling, and on September 17th we will have our appeals court hearing!
The Judges will be sitting “en banc” ~ (on bonk) French for “in the bench,” it signifies a decision by the full court of all the appeals judges in jurisdictions where there is more than one three- or four-judge panel. The larger number sit in judgment when the court feels there is a particularly significant issue at stake or when requested by one or both parties to the case and agreed to by the court. (Law.com)
